Abstract

Tulisan ini menyorot fenomena good governance dikaitkan dengan munculnya ruang public (public sphere) di tengah-tengah masyarakat Indonesia. Penulis mengambil kasus gagasan Counter Legal Draft Kompilasi Hukum Islam dan berbagai corak reaksi dan respon masyarakat sebagai contoh ruang publik yang patut diapresiasi. Sebagai kesimpulan, dapat dikatakan bahwa ketersediaan ruang publik tidak lebih dari sekadar penciptaan iklim/atmosfir yang kondusif dan kokoh untuk melanjutkan agenda pembangunan good governance yang masih belum berjalan seutuhnya.Keywords: good governance, public sphere, Islamic law reform, the CLD of KHI

Abstract

The aim of this writing is to describe the relationship between religious ethics and good governance values to create a good corporate governance and good government governance. Some people argue that the implementation of the good corporate governance is not satisfactory yet, due to the lack of awareness of the government authority, private companies’ stakeholders, scholars, and society on the importance of the system for both government and non-government organizations. Therefore, to provide a comprehensive understanding to the scholars and practitioners, this paper attempts to explain the corporate governance anatomy, Islamic values, and social condition of Indonesian society, which may become an appropriate model of corporate governance for the private companies, government institutions, government, and non-government organizations.

Abstract

Umar ibn Abd Aziz was a great leader throughout Islamic history. He has shown an outstanding role in the Umayyad Dynasty. He differed from some of his corrupt, unkind and injustice predecessors. This Caliph, well-known as Umar II, usually made popular policies to his people. He is the legendary leader who has many interesting historical evidences that encourage researchers to make further studies. His policies were always based upon Al-Qur’an and Hadits. On the one hand, he led and treated his people with justice; and on the other, he was very strict to his officials or people who corrupt or violate Allah’s rules. This study reveals various political decisions that were made during his leadership. Based on the various sources, many political decisions that he made may become references to be followed by Moslem leaders today and in the future time.Keywords: Economic policy, government system, social welfare, and justice

Abstract

After the destruction of the U.S. World Trade Center on September 11, 2001, America was focusing its international political policy on war on terrorism which was further followed by preemptive action and unilateralism toward countries considered as terrorists. One of them is Iraq. Certainly the policy will obstruct the realization of good world governance under the United Nations Program. Attacking Iraq in 2003 was a real proof of the U.S. hegemony over the world as the Super Power country, especially concerning Saddam Hussein’s judicial process which was held by the Iraqi Special Tribunal which was under the U.S. intervention. Theoretically, the judicial process of Saddam Hussein’s case who was accused of genocide toward Kurdish should be held by the International Criminal Court (ICC) under the United Nations. It was not the competence of the Iraqi Special Tribunal. Saddam Hussein’s trial was invalid and violated the principals of international law. This case would obstruct the enforcement of international law supremacy which is one of the requirements of good world governance. Since international politics is under the U.S. hegemony, the realization of good world governance is in jeopardy.Keywords: Governance, politics, hegemony, and law supremacy

Pembahasan dalam tulisan singkat ini terdiri dari tiga bagian utama. Bagian pertama akan membahas dengan singkat asal usul bahasa Arab dan datangnya agama Islam sebagai awal yang penting dalam membentuk dan mengkaji bahasa Arab. Bagian kedua akan membahas tentang perubahan dan pembaharuan sejarah dalam bahasa Arab selama periode awal Islam (sastra Arab) dan periode pertengahan, dalam arti yang luas, meliputi perkembangan ilmu pengetahuan dan sikap para cendikiawan pada saat itu. Dan pada bagian akhir, untuk memperoleh secara utuh permasalahan modern dari perubahan dan pembaharuan bahasa Arab tersebut, dua sarjana kontemporer Timur Tengah dipilih untuk memberi komentar terhadap masalah ini.Keyword: Arabic language, history, modernization, and language development

Abstract

From Good Governance perspective, Indonesia has given positive contribution toward gender issues. Legally, Indonesia has fulfilled all conditions as state with good governance, but unfortunately, at the field showed that such ordinances issued were ineffective. PSI-UII’s research report has found the correlation between violence against women and religious understanding. In the field finding will give inputs to all people who concern with the issue. Several Muslim scholars already had given us some solution with interpretation toward al-Quran and Hadits, which support gender justice and equality. Government and all organization involved, have to support law and its instrument can be applied well.Keywords: governance, gender, religious interpretation.

Abstract

Tulusan ini hendak mengkritik kondisi politik umat Islam Indonesia dewasa ini. Hal ini didasarkan pada adanya sekian banyak konsep politik dalam Islam sebagaimana juga ada dalam agama-agama besar lainnya. Dengan merujuk pada adanya keyakinan dalam agama Islam (tauhid), dimungkinkan untuk menjawab berbagai tuduhan yang dialamatkan pada umat Islam dewasa ini. Pembahasan diawali dengan membahas konsep diktator dan kemudian diakhiri dengan konsep demokrasi. Hasilnya menunjukkan bahwa ada banyak konsep dalam Islam tentang politik kenegaraan sehingga sistem politik demokrasi hanyalah merupakan salah satunya saja. Dengan demikian, isu yang selama ini dibangun secara universal seperti adanya benturan peradaban sebagaimana diusung Huntington ternyata tidak terbukti, melainkan hanyalah pertarungan interen peradaban saja. Petunjuk utamanya adalah adanya sistem demokrasi di dalam ajaran Islam itu sendiri.Keyword: Muslim politics, cultural Islam, democracy, pluralism, and tolerance

Abstract

This article tries to explore the possibilities of tasawuf ethic application to actualize Good Governance in Indonesia. The study focuses on some arguments why tasawuf and al-Ghazali are selected as the main discussion. The arguments are that Tasawuf is an Islamic tradition and al-Ghazali has capability for it in terms of his social lives. He proposed three concepts of thought concerning tasawuf ethics, that is, zuhd, teleological ethics, and ummahat al-fadhail. Abstract

The role and function of religion recently in the government system seem to have problems because of the believers itself. The fact shows that in the government order that is led by most righteous people, the management indicates various deficiencies, such as inefficiency, authority abuse, collusion, corruption, nepotism, and society’s cooptation to support the political party of the regime. Therefore, to improve the order, it cannot be subjected to the religion believers only, without strengthening the good governance. This last statement requires knowledge, attitude, and action of the public service officials. Furthermore, this is a step of improvement of political abuse, including bad performance of bureaucracy. The article tries to highlight the significant role of religious consciousness relevant to the development of good governance. Good governance will be well-implemented, if each takes part actively, together with government, in developing community’s understanding on the importance of rational-egalitarians in the government system. It is also required a firmness of moral principles and ethic awareness of all public service officials and society to execute the good governance in the government system.Keywords: bureaucracy, religion, irrational-hierarchical and rational-egalitarian
